01 Acceptance of terms
These Terms of Service ("Terms") are a legal agreement between you and Kumpali Private Limited ("Loanx", "we", "us") governing your use of the Loanx mobile application (the "App"). By downloading, installing, or using Loanx, you agree to these Terms. If you do not agree, do not use the App.
02 Description of the service
Loanx is a mortgage-backed loan record management app for Android and iOS. It lets individuals and small businesses record money lent against pledged assets, borrower details, repayments, loan history, related documents, and receipts they can send via WhatsApp or Telegram, or print. Loanx does not require you to create an account, and stores your records on your device, with optional backup and restore using your own Google Drive.
03 Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use Loanx. By using the App, you confirm that you have the legal capacity to enter into these Terms and that your use of the App to record lending activity complies with the laws that apply to you, including any local licensing or registration requirements for money-lending.
04 Loanx is a record-keeping tool, not a lender
- Any lending, interest charged, or collection activity you record is entirely your own transaction, entered into at your own discretion and risk.
- You are solely responsible for complying with the money-lending, usury, consumer-protection, tax, and data-protection laws that apply in your location — including any requirement to hold a money-lender's license.
- Loanx does not verify the accuracy of any entry, and a receipt generated by the App is only as reliable as the information you entered.
- We do not mediate disputes between you and a borrower. Any dispute over a loan is between you and that individual.
05 No login; your responsibility for your device
Loanx does not use accounts or passwords. This means anyone with access to your unlocked device can view and edit your Ledger Data within the App. You are responsible for securing your device (for example, with a screen lock) and for any activity that occurs through it.
06 Google Drive backup
If you enable backup, Loanx saves a copy of your Ledger Data to your own Google Drive once per day, using Google's APIs. If you choose to restore, Loanx reads its own backup file from your Google Drive. These features depend on Google's services being available and functioning, and on your Google account remaining accessible to you. We are not responsible for data loss caused by Google service outages, changes to Google's APIs, or loss of access to your Google account.
08 Acceptable use
You agree not to use Loanx to:
- Record or facilitate lending activity that is illegal in your jurisdiction, including unlicensed money-lending where a license is legally required, or interest rates above any legal cap
- Harass, threaten, or intimidate a borrower or any other person
- Enter false, fraudulent, or misleading records, or generate receipts intended to deceive a third party
- Reverse-engineer, decompile, or interfere with the App's normal operation
- Use the App in a way that violates Google Play, Apple App Store, WhatsApp, or Telegram policies
We may suspend or discontinue your ability to use the App if we become aware of a violation of these Terms, to the extent that is technically possible given the App does not use accounts.
09 Intellectual property
The Loanx name, logo, app design, and underlying software are owned by Kumpali Private Limited or its licensors and protected by intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable license to use the App for your personal or business record-keeping, and no other rights. Your Ledger Data — the information you enter — remains yours.
10 Third-party platform terms
Your use of Loanx is also subject to the terms of the platform you downloaded it from and the services it connects to:
- Google Play Terms of Service
- Apple Media Services Terms and Conditions
- WhatsApp Terms of Service
- Telegram Terms of Service
Where these Terms conflict with a mandatory provision of an applicable platform's terms, the platform's terms govern your use of that platform's services.
11 Disclaimer of warranties
Loanx is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that any backup or receipt will be delivered successfully. You use the App at your own risk.
12 Limitation of liability
To the maximum extent permitted by law, Kumpali Private Limited and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or lending records, arising from your use of or inability to use the App — including losses arising from a borrower dispute, a failed backup, or a failed message delivery. Our total liability for any claim relating to the App will not exceed ₹100.
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above limitations may not apply to you.
13 Indemnification
You agree to indemnify and hold harmless Kumpali Private Limited from any claim, loss, or demand, including reasonable legal fees, made by any third party (including a borrower) arising out of your use of the App, your lending activity, or your violation of these Terms or applicable law.
14 Termination
You may stop using Loanx at any time by uninstalling the App. Because Loanx does not use accounts, there is no separate account to close; uninstalling removes local Ledger Data that has not been backed up. We may modify, suspend, or discontinue the App, in whole or in part, at any time, including by removing it from the Google Play Store or Apple App Store.
15 Governing law and disputes
These Terms are governed by the laws of India, without regard to its conflict-of-law principles, except where applicable consumer-protection law in your country of residence requires otherwise. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Jamui, Bihar, India, unless applicable law gives you the right to bring a claim in your local courts.
16 Changes to these terms
We may update these Terms from time to time, for example to reflect new features, legal requirements, or platform policy changes. We will update the "Last updated" date above and, for material changes, provide notice within the App or through the app store listing. Continuing to use the App after a change takes effect means you accept the updated Terms.
